Hire Contract - Terms of Hire

  1. Definitions

    1. The ‘Hirer’ means the person signing the booking form for ‘Hire of equipment’. 

    2. The "Company" means Little Slumber Party.

    3. 'Dry' hire is the hire of equipment for the ‘Hirer’ to operate and supervise themselves.

    4. 'Wet' hire is the hire of equipment or entertainment accompanied by a representative of the 'company' to supervise use of the booked equipment or entertainment.

    5. The period of hire is from the agreed date until the following day at an agreed time unless stated otherwise. 
       

  2. Bookings 

    1. Our tents are not suitable for dogs or other animals. However, disabled assistance dogs (e.g. guide dogs, hearing dogs etc) are welcome by prior arrangement. 

    2. Hire price includes delivery within 15 miles from GU10 Farnham, then delivery fees will apply (contact for details).

    3. All equipment remains the property of the Little Slumber Party at all times.

    4. In the event of traffic or other uncontrollable circumstances preventing Little Slumber Party from being able to fulfil our contractual obligations our liability shall be limited to a refund of any monies paid, other than the deposit, in relation to the contracted event or a pro rata reduction in the hire fee in the event of delayed start. No further compensation will be paid. 
       

  3. Prices, Deposit & Balance Payments 

    1. All hires are subject to a refundable security deposit of £40 after inspection of any damage to the equipment hired.

    2. The balance is to be paid in full and cleared 14 days prior to the event start date of the party.

    3. The final numbers and choices must be confirmed at least 14 days prior to the date of the booking. Any booking reductions after this time will still be charged for at the previous rate, with no refunds due. 
       

  4. Location, Facilities & Conduct 

    1. Hired equipment will be set up in one location only as agreed on arrival and will not be moved once set up.

    2. It is the responsibility of the Hirer to ensure there is sufficient access and space for the tents. The tents are 100cm wide. Mattresses are 160cm in length, with an extra 40cm for the tray we usually place at the end of the mattress. 

    3. The Hirer will be responsible for any movement of furniture for the tents.

    4. Little Slumber Party reserves the right to refuse delivery if the venue or site is deemed to be unsuitable. In such a case no refund will be given and the full hire fee will be due.  

    5. Little Slumber Party will deliver, set up and furnish your tents to the agreed location on the first day of the commencement of your booking. 

    6. Little Slumber Party will dismantle and remove all equipment from your event location on the day of termination of your hire period.
       

  5. Liability & Insurance 

    1. Little Slumber Party’s liability insurance covers use of the equipment only whilst booked on 'wet' hire (supervised by a representative of the company).
    2. The Hirer agrees to indemnify the Little Slumber Party for any damage or theft of the company's equipment whilst on hire.  

    3. The Little Slumber Party accepts no liability for any damage or loss of personal property and or any injury arising from the use of the hired equipment.

    4. Nothing in these terms shall limit or exclude the liability of Little Slumber Party, which may not be limited or excluded by law, including without limitation liability for death or personal injury caused by Little Slumber Party negligence or fraudulent misrepresentation. 

    5. Subject to the above Little Slumber Party shall have no liability (whether arising under contract, tort, or for breach of statutory duty or otherwise) to the extent that such liability would not have arisen but for the Hirer breach of the contract.

    6. Subject to the above clauses Little Slumber Party aggregate liability for all claims in relation to the contract (whether arising under contract, tort, or for breach of statutory duty or otherwise) shall not exceed the price paid by the Hirer. 

    7. This contract is governed and construed in accordance with English law and the parties irrevocably submit to the exclusive jurisdiction of the courts of England. 

    8. No information included in this booking form will be disclosed to any third party. 

    9. It is the responsibility of the Hirer to inform guests accordingly of the above terms and conditions. 

    10. Little Slumber Party has suitable public liability insurance and takes the upmost care to ensure the safety of all party guests at all times. Little Slumber Party tents and canopies are independently tested and marked CE in accordance with the Toy Safety Regulations UK 2011.

    11. Little Slumber Party use high quality products and follow strict hygiene routines. 

    12. Liability cannot be taken for reactions or injury sustained whilst attending a party or thereafter. 

    13. All persons using Little Slumber Party equipment do so at their own risk and it is the party Hirer who is responsible / liable for any damage or injury occurring from or as a result of inappropriate use or misuse or reckless use. 

    14. This information is given for the safety of all people attending a party hired from Little Slumber Party and it is the sole responsibility of the Hirer to ensure that they are understood and adhered to by all party guests invited.
       

  6. Contract Terms & Conditions of Hire
    (If the Hirer is in any doubt as to the meaning of the following, a representative from Little Slumber Party should immediately be consulted before signing) 

    1. The Hirer will, during the period of hiring, be responsible for the supervision of the equipment, its care, safety from damage however slight or change of any sort, and the behavior of all persons of all ages using the equipment whatever their capacity, including proper supervision of children. Little Slumber Party excludes any liability for injury loss or damage caused to any person using the equipment contrary to the terms and conditions of this Contract. 

    2. It is the Hirers responsibility to ensure that the children are supervised at all times. Little Slumber Party will charge the Hirer for the costs of any damage to any property caused by your breach of this clause. 

    3. It is the Hirers responsibilities to ensure the children comply with all reasonable instructions from Little Slumber Party to ensure the safety of the attendees and other persons present. Little Slumber Party may suspend the event if you are in breach of this clause. 

    4. The Hirer is responsible for providing Little Slumber Party with all relevant medical/dietary information for all the children attending the party. Little Slumber Party will take no responsibility for allergies (including skin, food, materials etc) where they are advised in advance of the condition. 

    5. The Hirer is responsible for ensuring the accuracy of the information given to Little Slumber Party and to pass over such information in sufficient time for Little Slumber Party to perform the contract safely and without risk, within 14 days of the event occurring, to avoid last minute disappointment. 

    6. The Hirer must be satisfied with the equipment before use and should notify Little Slumber Party of any miscounts, incorrect deliveries and unacceptable equipment before use. Failure to do so will be the responsibility of the client and NOT Little Slumber Party. 

    7. In all hiring contracts the refundable deposit of £40 in the form of bank transfer or PayPal is payable to secure the booking. Such deposit will be returned to the Hirer normally within 24 hours of return of the equipment via cash or bank transfer, unless the hired equipment and any accessories have been damaged or lost during the period of hire and in such circumstances the deposit will be used in full or part payment of those repairs/replacements. The Hirer shall indemnify Little Slumber Party for the full cost of repair or replacement of any damage done to any equipment which may occur during the period of the hiring. 

    8. The Hirer shall not use the equipment for any purpose other than that described in the hiring agreement, and shall not sub hire or use the equipment or allow the equipment to be used for any unlawful purpose or in any unlawful way, nor allow anyone onto the equipment wearing shoes, carrying sharp objects, key-rings, metal studded clothing or any other similar items which could cause damage to others or the equipment. 

    9. No food or drink is to be consumed on or in the equipment. 

    10. The Hirer should not use the equipment outside. 

    11. Public liability insurance is excluded in its entirety following any claim or injury to any third party or employee whether directly or indirectly related to the use of drugs and/or alcohol.

    12. If the Hirer wishes to cancel the booking for whatever reason, the following cancellation charges will become payable.
      - If the Hirer cancels 4 weeks or less from the party date, you will forfeit the deposit paid of £40. Rescheduling to another date will retain the deposit paid.
      - If the Hirer cancels once you have paid the full cost of your tent hire, we are unable to return any monies to you, unless we are able to rebook the sleepover for the period in question.

    13. If the event for which the tents have been hired is cancelled, Little Slumber Party shall not be liable. 

    14. Your hire booking will be treated as cancelled if the balance of the hire payment is not received by us by 7 days before the commencement of your hire or unless alternate payment terms have been agreed.

    15. Little Slumber Party reserves the right to cancel the booking at any time for any reason (Little Slumber Party will try to give as much notice as possible).

    16. Upon any such cancellation Little Slumber Party will refund to the Hirer any monies paid to Little Slumber Party in respect of the booking but Little Slumber Party will not be liable to pay any compensation to the Hirer or any other person for any loss, damage or expenditure arising directly or indirectly from the cancellation. 

    17. Little Slumber Party reserves the right to terminate the booking without notice if there is a breach of these conditions. 

    18. At the end of the hiring the Hirer shall be responsible for leaving the equipment in a clean and tidy condition. All rubbish/recycling must be removed at the end of your event prior to collection otherwise Little Slumber Party shall be at liberty to make an additional charge. If the Hirer fails to return the equipment in a clean and tidy condition Little Slumber Party are entitled to levy a further charge if necessary.
       

  7. Supervision

    1. The Hirer is responsible for the care and safety of all the children and should ensure that all parents/guardians are aware that Little Slumber Party is not responsible for the care and safety of the children. 

    2. The Hirer will be required to take responsibility for all children that have been left by their parent/guardian. 

    3. We would recommend that the Hirer of the party take contact telephone numbers of the children attending if their parent/guardian is not staying at the same time as clarifying any medical/allergic conditions at least 14 days in advance of the event.

    4. Whilst we love our furry friends we ask in the interest of health and hygiene that domestic pets are not allowed access to the hire equipment. Any additional cleaning as a result of access to the equipment by pets may result in an additional charge.
       

  8. Health and Safety

    1. Little Slumber Party operates a STRICT NO SMOKING policy inside the tents. 

    2. Candles with flames are not permitted inside the tents. Battery operated candles will be provided. 

    3. Some produce used may contain traces of nuts or may have been made in a factory that handles nuts. Please carefully check all ingredients before use/application.

    4. Tents must not be set up near an open fire.

    5. Mobile phones must not be left charging inside the tent set up.
       

  9. General

    1. It is not the intention of Little Slumber Party to violate any copyright laws and all themes are only inspired by popular trends. 

 

Any inadvertent delay, omission, or error in complying with the terms and conditions of this Contract shall not be held to relieve either party hereto from any liability, which would attach to it hereunder if such delay, omission, or error had not been made, provided such delay, omission, or error is rectified upon discovery. 

 

Our fabulous sleepover tents are supplied with love and care. We are passionate about what we do and our mission is to provide high quality, beautifully decorated tents for our customers’ special celebrations so we kindly ask that care is taken with the tents and equipment provided.
